Class Offense Definition

Burglary means intentionally entering or remaining unlawfully in a building with intent to commit therein a crime against a person or against property rights.

Elements Checklist

1. Intentionally entering OR remaining UNLAWFULLY in a building

2. With intent to commit a crime AND

3. Against a person OR against property rights.
