Class Offense Definition

 

Disorderly conduct means:
 

  1. Engaging in fighting or threatening, or in violent or tumultuous behavior such as yelling or screaming, or both;

  2. Making unreasonable noise as to cause disruption of normal school operations;

  3. Making any offensively coarse utterance, gesture, or display, or addressing abusive language to any person present, which is likely to provoke a violent response;

  4. Creating a hazardous or physically offensive condition by any act which is not performed under any authorized license or permit; or

  5. Impeding or obstructing any person in a public school for the purpose of begging or soliciting alms or other forms of aid;with the intent to cause physical inconvenience or alarm to a member or members of the public school, or recklessly creating a risk thereof.

 

Elements Checklist

 

  1. Engaging in fighting or threatening OR in violent tumultuous behavior such as yelling or screaming or both. OR

  2. Making unreasonable noise as to cause disruption of normal school operations. OR

  3. Action likely to provoke a violent response:

    1. Any offensive utterance,

    2. Any offensive gesture.

    3. Any offensive display OR

    4. Addressing abusive language to any person present. OR

  4. Creating a hazardous OR physically offensive environment by any act which is not performed under any authorized license or permit OR

  5. Impeding OR obstructing any person in a public school for the purpose of begging or soliciting alms or other forms of aid.

    1.  With intent to cause physical inconvenience OR alarm to a member or members of the public school, OR recklessly creating a risk thereof.
